I concur in today’s order[1] because it follows Commission precedent.  I write separately merely to state that I sympathize with many of Commissioner Christie’s concerns, particularly regarding the Commission’s process for awarding Construction Work in Progress (CWIP).[2]  The Commission should reexamine this process thoughtfully and deliberately, preferably through a generic proceeding.

For these reasons, I respectfully concur.
