These are summaries of orders voted by the Federal Energy Regulatory Commission at its January 16 public meeting. Links to each order will be provided below once the order is issued.  The summaries are produced by FERC’s Office of External Affairs and are intended to provide only a general synopsis of the orders. These summaries are not intended as a substitute for the Commission’s official orders. E-1 | Southwest Power Pool, Inc., Docket No. ER24-1658-000, et al.
ORDER ACCEPTING PROPOSED TARIFF, SUBJECT TO CONDITION

The order accepts Southwest Power Pool, Inc.’s (SPP) proposed tariff to implement a centralized day-ahead and real-time unit commitment and dispatch market in the Western Interconnection (Markets+ Tariff), subject to SPP submitting a compliance filing within 30 days of the date of the order.  The order also directs SPP to submit an informational filing notifying the Commission of the actual effective date of the proposed Markets+ Tariff and informational reports every six months during the implementation period as well as every six months for a period of three years after the Markets+ Tariff effective date.

ORDER ON COMPLIANCE FILING

The order accepts Midcontinent Independent System Operator, Inc.’s (MISO) second Order No. 2222 compliance filing and directs MISO to submit further compliance filings within 60 days and 180 days of the order.  

E-3 | Southwest Power Pool, Inc., Docket Nos. ER24-1317-000 and ER24-2953-000
ORDER ACCEPTING AND SUSPENDING PROPOSED TARIFF REVISIONS, CONSOLIDATING PROCEEDINGS, AND ESTABLISHING PAPER HEARING PROCEDURES

The order addresses Southwest Power Pool, Inc.’s proposed changes to its tariff to implement an Effective Load Carrying Capability methodology for wind, solar, and storage resources; a performance-based accreditation (PBA) methodology for conventional resources; and a fuel assurance incentive related to the proposed PBA methodology. The order accepts and suspends the proposed tariff revisions.  Additionally, the order consolidates Docket Nos. ER24-1317-000 and ER24-2953-000 and establishes paper hearing procedures to allow parties to provide additional comment on the now-consolidated proceeding.

ORDER ACCEPTING TARIFF REVISIONS

The order accepts Southwest Power Pool, Inc.’s (SPP) proposed revisions to its tariff to address price formation during load shed and emergency assistance events and directs SPP to submit an informational filing notifying the Commission of the actual effective date of the tariff revisions.

The order accepts Tampa Electric Company’s Order Nos. 2023 and 2023-A compliance filing in part and directs Tampa Electric Company to submit a further compliance filing.

E-8 | CMD Carson, LLC, Docket No. TX23-3-001
ORDER DISMISSING REHEARING REQUEST AND GRANTING CLARIFICATION

The order dismisses, for lack of finality, a request for rehearing filed by CMD Carson, LLC (Carson) of the Commission’s August 15, 2024, order, which addressed Carson’s request for interconnection and transmission services under sections 210 and 211 of the Federal Power Act.  The order also grants Carson’s separate request for clarification. 

E-9 | Ohio Power Co., Docket No. ER24-2720-000
ORDER REJECTING REFUND REPORT AND DIRECTING REVISED REFUND REPORT

The order: (1) rejects Ohio Power Company’s refund report filed in compliance with a delegated order accepting an Operations Agreement between Ohio Power Company and Trans-Allegheny Interstate Line Company; and (2) directs Ohio Power Company to seek reimbursement of time-value refunds and file a revised refund report. 

E-10   Constellation Mystic Power, LLC, Docket Nos. ER18-1639-029, ER18-1639-000, ER23-1735-000, and EL23-4-000
ORDER APPROVING UNCONTESTED SETTLEMENT

The order approves an uncontested settlement filed by Constellation Mystic Power, LLC (Mystic) on behalf of itself and its affiliate Constellation Energy Generation, LLC (Constellation) to resolve all outstanding issues related to the cost-of-service agreement among Mystic, Constellation, and ISO New England Inc.

ORDER ON CONTESTED SETTLEMENT

The order approves a contested settlement agreement and a settlement rate schedule for the Indian River Unit 4 generating facility. 


G-1 | Plains Pipeline, L.P. and Sunrise Pipeline LLC, Docket No. OR23-3-001
ORDER ON PAPER HEARING

The order grants Plains Pipeline, L.P., and Sunrise Pipeline LLC’s application to charge market-based rates for the transportation of crude oil for the proposed Wichita Falls destination market.

ORDER ADDRESSING ARGUMENTS RAISED ON REHEARING

In response to a request for rehearing, the order modifies and sustains the Commission’s October 15, 2024, notice denying American Whitewater’s late motion to intervene in the surrender proceeding for the 3-megawatt Niangua Project, located on the Niangua River in Camden County, Missouri

H-2 | Village of Highland Falls High-Point Utility, LDC, Project No. 7656-021
ORDER ADDRESSING ARGUMENTS RAISED ON REHEARING

In response to a request for rehearing, the order modifies and sustains the Commission's September 19, 2024, order which revoked the license for High-Point Utility's Buttermilk Falls Project No. 7656, located in Orange County, New York.


C-1 | Eastern Shore Natural Gas Company, Docket No. CP23-536-000
ORDER ISSUING CERTIFICATE

The order issues a certificate for Eastern Shore Natural Gas Company's proposed Worcester Resiliency Upgrade Project providing storage for approximately 39,627 Dth equivalent of LNG and 14,000 Dth/day of bundled firm transportation service to shippers on the Eastern Shore system in Delaware and Maryland.
