Constructing a Rate Filing (Market Based or Cost Based)

Pipelines may choose one of two methods to establish cost-based rates:
 

1. State Rate Election (b)(1) – § 284.123(b)(1) of the Commission's regulations.
2. Cost of Service (b)(2) – § 284.123(b)(2) of the Commission's regulations.

Pipelines may file to request Commission approval of market based rates upon showing a lack of market power. The filings must be made pursuant to Subpart M of Part 284 of the Commission’s regulations. The filing must comply with § 284.503.
 

1. NGA Hinshaw Pipelines must make a filing in the form of a request for declaratory order and comply with Part 154.
2. NGPA section 311 Pipelines must make a filing in the form of a rate case in accordance with § 284.123(b)(2).
