As explained in my September 12, 2019 statement, I recently learned that I received incorrect guidance regarding the Trump Administration's Ethics Pledge. The correct interpretation of the Ethics Pledge requires that I recuse myself from all proceedings in which AvanGrid (and its affiliates and subsidiaries) is a participant until November 29, 2019, two years from the date of my appointment to FERC. After giving it considerable thought, I have decided not to seek a waiver from this requirement.
I take very seriously the obligations contained in the Ethics Pledge, which I signed when I joined the Commission and it has always been my intent to comply with those obligations. I do not believe that seeking a waiver would be consistent with the commitment I made when I signed the Ethics Pledge.
I recognize that there are certain items on which I will not be able to work prior to November 29, 2019, and that my recusal might determine whether a quorum exists for the next 71 days. However, I anticipate that my recusals will not impact the vast majority of proceedings and that the important work of the Commission will continue.
