These are summaries of orders voted by the Federal Energy Regulatory Commission at its June 27 public meeting. The summaries are produced by FERC’s Office of External Affairs and are intended to provide only a general synopsis of the orders. E-2      Midcontinent Independent System Operator, Inc., Docket No. EL23-2977-000, et al.

Order Accepting Tariff Revisions

The order accepts Midcontinent Independent System Operator, Inc.’s (MISO) proposed tariff revisions to implement a downward sloping Reliability Based Demand Curve in the Planning Resource Auction, beginning with the 2025/2026 Planning Year, replacing MISO’s existing vertical demand curve. 


E-3      PJM Interconnection, L.L.C., Docket No. ER17-1433-005

Order on Remand

The order addresses remand by the U.S. Court of Appeals for the District of Columbia Circuit’s of two Commission orders issued in 2022 that accepted PJM Interconnection, L.L.C.’s (PJM) revisions to its forfeiture rule for Financial Transmission Rights (FTR Forfeiture Rule) for further explanation of the Commission’s decision to exclude consideration of leverage, or whether a transaction creates net profit for the FTR holder, as a required element of the rule. The order affirms the Commission’s prior decision that the current FTR Forfeiture Rule is just and reasonable even though it does not include a proposed leverage test. 


E-4      North American Electric Reliability Corp., Docket No. RD24-5-000

Order Approving Extreme Cold Weather Reliability Standard EOP-012-2 and Directing Modification

The order accepts North American Electric Reliability Corporation’s (NERC) proposed modifications to Reliability Standard EOP-012-2 (Extreme Cold Weather Preparedness and Operations), two newly defined terms, two revised definitions of terms, the Standard’s associated violation risk factors and violation severity levels, NERC’s implementation plan, and the retirement of Reliability Standard EOP-012-1.  The order also directs NERC to develop and submit five modifications to the proposed Standard within nine months of the order’s date of issuance to further enhance cold weather preparedness.  


E-5      Revisions to Regulations on Electric Reliability Organization Performance Assessments, Docket No. RM21-12-000

Revisions to Regulations on Electric Reliability Organization Performance Assessments

The order withdraws a notice of proposed rulemaking on amending the Commission’s regulations regarding the Electric Reliability Organization’s performance assessments and terminates the proceeding.


E-6      North American Electric Reliability Corp., Docket No. RR24-2-000

Order Approving Revisions to North American Electric Reliability Corporation Rules of Procedure and Requiring Compliance Filing

The order approves NERC’s proposed revisions to its Rules of Procedure, subject to NERC submitting a compliance filing, under section 215 of the Federal Power Act.  The revisions facilitate the registration of owners and operators of inverter-based resources that are connected to the Bulk-Power System.


E-7      Gregory and Beverly Swecker Docket No. EL24-6-000

Order Denying Data Request

The order denies Gregory and Beverly Swecker’s request for Midland to provide the avoided cost rate at which Midland, as an all-requirements buyer, purchases from Central Iowa Power Cooperative.


E-8      Southern California Edison Co., Docket No. EL24-71-000

Order on Transmission Rate Incentives   

The order grants Southern California Edison Company’s (SoCal Edison) petition for declaratory order requesting certain transmission incentives for the Del Amo-Mesa-Serrano 500 kV Reinforcement Project and the Lugo-Victor-Kramer 230 kV Upgrade Project.  Specifically, SoCal Edison requests 100 percent of prudently incurred Construction Work in Progress for the projects in rate base and recovery of 100 percent of prudently incurred costs of the projects if they are abandoned for reasons beyond SoCal Edison’s control.


E-9      Missouri River Energy Services v. Southwest Power Pool, Inc., Docket No. EL24-3-000 

Order Denying Complaint 

The order denies Missouri River Energy Services’ (Missouri River) complaint against Southwest Power Pool, Inc. (SPP).  Missouri River had alleged that SPP, by allocating to Missouri River zero Long-Term Transmission Congestion Rights (LTCR) in the March 2016 LTCR allocation and every annual allocation since, violated the SPP Open Access Transmission Tariff and Order No. 681.


E-10    Southern Power Company, Docket No. ER23-150-000

Order Granting Authorization to Make Affiliate Sales

The order grants Southern Power Company authorization to sell energy, capacity and ancillary services to its affiliate, Georgia Power Company pursuant to a competitive request for proposals.


E-11   Southwest Power Pool, Inc., Docket No. ER22-1697-002

Order Addressing Arguments Raised on Rehearing and Granting Clarification in Part

In response to a request for rehearing and clarification, the order further explains and sustains the Commission’s March 1, 2024 order, which conditionally accepted SPP’s filing to comply with the requirements of Order No. 2222.  Order No. 2222 removes barriers to the participation of distributed energy resource aggregations in the capacity, energy and ancillary services markets in organized wholesale power markets.   The order also grants in part the request for clarification. 


E-12    Oak Trail Solar, LLC, Docket No. ER23-1752-003, et al.

Order Addressing Arguments Raised on Rehearing

In response to a request for rehearing, the order further explains and sustains the Commission’s February 16, 2024, order, that, among other things, accepted for filing Oak Trail Solar, LLC’s (Oak Trail) proposed reactive power rate schedule under Schedule 2 of the PJM Tariff, to be effective July 7, 2023, the date of commercial operation of Oak Trail’s 100 MW solar generating facility. 


E-13    Cometa Energia, S.A. de C.V., /o/b/o., Energia Azteca X, S. de R.L. de C.V. v. California Independent System Operator Corporation, Docket No. EL24-92-000

Order Denying Complaint

The order denies a complaint by Cometa Energia, S.A. de C.V. (Saavi) alleging that the California Independent System Operator Corporation unlawfully terminated Saavi’s full capacity deliverability status associated with the Saavi combustion turbine Unit C generator. 


E-14  Canisteo Wind Energy LLC, Docket No. ER24-1881-000

Order Granting Waiver Request

The order grants Canisteo Wind Energy LLC's (Canisteo) request for waiver of section 30.4.4.5.1 of Attachment X to the New York Independent System Operator, Inc.'s (NYISO) Open Access Transmission Tariff. Attachment X of the Tariff provides that extensions of the commercial operation date for interconnection requests will not be considered material modifications if the proposed commercial operation date is within four years of the date on which NYISO completed the Class Year Facilities Study. The waiver is granted to ensure that Canisteo's interconnection agreement accurately reflects the commercial operation date of its project.


E-15    PJM Interconnection L.L.C., Docket No. ER23-1067-002

In response to a request for rehearing, the order further explains and sustains the Commission’s April 7, 2023, order, which accepted PJM’s proposed changes to the Effective Load Carrying Capability construct.  


E-16    Roy J. Shanker v. PJM Interconnection, L.L.C., Docket No. EL23-13-000

Order Denying Complaint

The order denies Roy J. Shanker’s (Dr. Shanker) complaint that PJM’s application of its Effective Load Carrying Capability (ELCC) process violates PJM’s governing documents. Dr. Shanker requests that the Commission direct PJM to comply with its governing documents and to make adjustments to all future Base Residual Auction (BRA) settlements and all prior BRA settlements “that are not time barred.”  The order finds that PJM’s ELCC process does not violate its governing documents. 


C-1      Algonquin Gas Transmission, LLC, Docket No. CP24-49-000

Order Denying Protests and Authorizing Construction

The order denies protests and authorizes Algonquin to construct and operate the Sakonnet River Replacement Project, in Newport County, R.I., under its blanket certificate authority.


C-2      Algonquin Gas Transmission, LLC, Docket No. CP24-21-000

Order Denying Protests and Authorizing Construction

The order denies protests and authorizes construction to Algonquin Gas Transmission, LLC to modify its existing E System Lateral Tap Site located in the Town of Coventry, Tolland County, Connecticut, under its blanket certificate authority. 


C-3      Spire STL Pipeline LLC, Docket No. CP17-40-018

Order Addressing Arguments Raised on Rehearing and Granting Clarification

In response to requests for rehearing filed by Central Land Consulting, LLC and landowners, the order further explains and sustains Commission staff’s March 6, 2024 delegated letter orders regarding Spire’s restoration plan for certain properties. 


C-4      Spire STL Pipeline LLC, Docket No. CP17-40-019

Order Denying Clarification and Addressing Request for Rehearing

In response to  a request for clarification, the order further explains and sustains the Commission’s March 6, 2024 rehearing order addressing Central Land Consulting’s request for rehearing of Commission staff’s findings in a May 5, 2023 letter order finding the restoration on the Gettings property is adequate.  


C-5      Venture Global CP2 LNG, LLC; Venture Global CP Express, LLC, Docket Nos. CP22-21-000 and CP22-22-000

Order Granting Authorizations Under Sections 3 and 7 of the Natural Gas Act

The order grants CP2 LNG’s request for NGA section 3 authorization to site, construct and operate the CP2 LNG export terminal in Cameron Parish, La.  The order also grants CP Express’s request for a certificate of public convenience and necessity under NGA section 7(c) to construct and operate the CP Express Pipeline Project to connect the CP2 LNG terminal to the existing natural gas pipeline grid in east Texas and southwest Louisiana.


C-6      Transcontinental Gas Pipe Line Company, LLC, Docket No. CP22-495-001

Order Addressing Arguments Raised on Rehearing

In response to a request for rehearing, the order further explains and sustains the Commission’s January 18, 2024 order granting a certificate of public convenience and necessity to construct and operate the Texas to Louisiana Energy Pathway Project in Fort Bend, Hardin, and Victoria Counties, Texas.


H-1      Pacific Gas and Electric Company, Project No. 77-320

Order Approving Temporary Variance of Flow Requirements Under License Article 52

The order grants Pacific Gas and Electric's request for a temporary variance from the minimum flow requirements for the Potter Valley Project No. 77, located on the East Branch Russian River and Eel River in Lake and Mendocino Counties, California.


H-2      City of Seattle, Washington, Project No. 553-245

Order Granting in Part and Denying in Part Petition for Declaratory Order

The order addresses the City of Seattle’s petition for declaratory order on whether a special use permit from the National Park Service is necessary to perform drone inspections or other operations and maintenance activities at the Skagit River Hydroelectric Project No. 553, on the Skagit River in Snohomish, Skagit, and Whatcom Counties, Washington and located within the boundaries of the Ross Lake National Recreation Area, which the Park Service administers as part of the North Cascades National Park .  The order finds that the licensee may conduct project-related drone flights on or across lands and waters administered by the Park Service so long as the licensee provides advance written notice to the Park Service and complies with certain reporting, safety, and environmental requirements, and that drones may be used to aid emergency confirmation and response efforts without prior Park Service notice, with a report filed with the Park Service as soon as possible, but no later than 24 hours after the emergency drone flight.


H-3      Grand River Dam Authority, Project No. 1494-468

Order Addressing Arguments Raised on Rehearing

In response to a request for rehearing, the order further explains and sustains the Commission’s January 18, 2024, order on remand for the Pensacola Hydroelectric Project No. 1494, located on the Grand (Neosho) River in Craig, Delaware, Mayes, and Ottawa Counties, OklahomaGrand River Dam Auth., 186 FERC ¶ 61,045 (2024) (Remand Order).  As in the Remand Order, the rehearing order continues to find that under the current license the Commission has the authority to direct the licensee to acquire any additional property rights necessary to address flood control issues at the project.
