The underground storage of natural gas has historically been critical in assuring that overall demands and use of specific requirements of natural gas customers are met.

The Energy Policy Act of 2005 added a new ยง 4(f) to the Natural Gas Act, stating that the Commission may authorize natural gas companies to provide storage and storage-related services at market-based rates for new storage capacity (placed into service after the date of enactment of the Act), even though the company can't demonstrate it lacks market power.

To make this authorization, the Commission must determine that market-based rates are in the public interest and needed to encourage the construction of the capacity and that customers are adequately protected. The Commission shall ensure that reasonable terms and conditions are in place to protect consumers and must periodically review the market-based rates authorized to ensure they remain just, reasonable and not unduly discriminatory or preferential.
